Buncombe County Business Owner Pleads Guilty in State Tax Case

RALEIGH – A Buncombe County business woman pleaded guilty Tuesday in Wake County Superior Court to felony charges filed by the North Carolina Department of Revenue.

Alina K. Rippy, 37, formerly of 50 Country Walk Lane in Sanford, now residing at 130 Pier Point Drive in Stony Point, NC, pleaded guilty on July 12, 2016 to two counts of Embezzlement of State Property.

Superior Court Judge Donald W. Stephens sentenced Rippy to a 16-month minimum, 29-month maximum prison term. The sentence was suspended and Rippy was placed on supervised probation for 60 months. As conditions of probation, Rippy was ordered to be placed under electronic home monitoring for 120 days, pay restitution of $20,748.27, pay a fine of $5,000.00, and complete 100 hours of community service. Rippy paid $6,500.00 toward restitution at the time of her plea, and was ordered to pay the remaining balance within 120 days.

Information presented in court showed that Rippy, the owner of Nana’s Assisted Living Facility, LLC, now located in Forest City, NC, aided and abetted the LLC to embezzle, misapply and convert to its own use $20,748.27 in North Carolina Withholding Tax during the period April 1, 2013 through July 15, 2014. During this period of time, Rippy held the position of President and was the responsible person of Nana’s Assisted Living Facility, LLC, which was under a duty to collect, hold in trust, and remit North Carolina State Taxes to the North Carolina Department of Revenue.

The charges against Rippy resulted from an investigation by a special agent with the Department’s Criminal Investigations Section in Hickory.
